Acceptance of Terms
By accessing and using the services provided by Mittal Technologies ("Company," "we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use our services.
These Terms and Conditions constitute a legally binding agreement between you (whether personally or on behalf of an entity) and Mittal Technologies concerning your access to and use of our website, services, and products.
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following the posting of changes constitutes your acceptance of such changes.
Services Description
Mittal Technologies provides comprehensive IT solutions and digital services including but not limited to:

- Consulting & Support: IT consulting and ongoing technical support
The specific scope of services will be detailed in individual project agreements or service orders. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.
User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password. You agree to:
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Ensure that you exit from your account at the end of each session
- Accept responsibility for all activities that occur under your account
We cannot and will not be liable for any loss or damage arising from your failure to comply with security obligations. Never share your account credentials with third parties.
User Obligations
As a user of our services, you agree to comply with all applicable laws and regulations. You further agree not to:
- Use our services for any unlawful purpose or to solicit others to perform unlawful acts
- Violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
- Infringe upon or violate our intellectual property rights or the intellectual property rights of others
- Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- Submit false or misleading information
- Upload or transmit viruses or any other type of malicious code
- Collect or track personal information of others without consent
- Spam, phish, pharm, pretext, spider, crawl, or scrape our services
- Use our services for any obscene or immoral purpose
- Interfere with or circumvent the security features of our services
We reserve the right to terminate your use of our services for violating any of these prohibited uses.
Intellectual Property Rights
The service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Mittal Technologies and its licensors.
Our services are protected by copyright, trademark, and other laws of India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Mittal Technologies.
Upon full payment for services rendered, clients will own the intellectual property rights to custom work created specifically for them, as outlined in individual project agreements. This does not include our proprietary tools, frameworks, or methodologies.
Mittal Technologies retains ownership of:
- All pre-existing intellectual property and proprietary tools
- General knowledge, skills, and experience gained during projects
- Reusable code components and frameworks
- Our brand assets, logos, and marketing materials
Payment Terms
All fees for our services are due as specified in individual project agreements or invoices. Payment terms typically include:
- Project Deposits: A deposit of 30-50% is required before project commencement
- Milestone Payments: Payments due upon completion of specified project milestones
- Final Payment: Full payment required before final delivery and transfer of files
- Recurring Services: Monthly or annual fees for ongoing services and support
We accept payment through bank transfer, credit cards, and other methods as specified in your invoice. All prices are in Indian Rupees (INR) unless otherwise stated.
Invoices not paid within 15 days of the due date will incur a late fee of 2% per month. We reserve the right to suspend services for accounts with overdue payments exceeding 30 days.
Refund Policy: Deposits are non-refundable once work has commenced. For ongoing services, refunds may be provided on a pro-rata basis for unused portions, at our discretion.
Confidentiality
Both parties agree to maintain confidentiality regarding all proprietary and sensitive information shared during the course of our business relationship. This includes but is not limited to:
- Business strategies and plans
- Technical information and trade secrets
- Customer and user data
- Financial information
- Proprietary software and source code
- Marketing strategies and materials
Confidential information does not include information that:
- Is or becomes publicly available through no breach of this agreement
- Was lawfully in the receiving party's possession before disclosure
- Is independently developed without use of confidential information
- Is rightfully obtained from a third party without breach of confidentiality

Warranties and Disclaimers
Our Warranties: We warrant that our services will be performed with reasonable care and skill, in accordance with industry standards, and as described in individual project agreements.
Disclaimer of Warranties: Except as expressly set out in these terms, we make no warranties or representations about the accuracy or completeness of our services or the content of any third-party services.
Our services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Freedom from harmful components
We may integrate third-party services into our solutions. We are not responsible for the availability, functionality, or content of third-party services. Your use of such services is subject to their respective terms and conditions.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Mittal Technologies, its directors, employees, partners, agents, suppliers, or affiliates be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Loss of business opportunities
- Business interruption
- Any other intangible losses
This applies whether the liability is based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
Liability Cap: Our total liability to you for all claims arising out of or related to these terms or our services shall not exceed the greater of:
- The amount you paid us in the 12 months preceding the claim, or
- ₹50,000 (Fifty Thousand Indian Rupees)
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
Termination
We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Termination by You: You may terminate your account at any time by:
- Providing written notice to us at least 30 days in advance
- Settling all outstanding payments and obligations
- Completing any ongoing projects or making arrangements for transition
Effect of Termination: Upon termination:
- Your right to use our services will immediately cease
- All licenses granted to you will terminate
- You must pay any outstanding amounts owed to us
- We may delete your account and all associated data
- Provisions that by their nature should survive termination will survive
Surviving provisions include but are not limited to: ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts in Ludhiana, Punjab, India.
We encourage you to contact us first if you have any concerns. We will make every effort to resolve disputes amicably through good faith negotiations. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue formal legal remedies.
Arbitration Option: By mutual agreement, disputes may be resolved through binding arbitration in Ludhiana, Punjab, in accordance with the Arbitration and Conciliation Act, 1996.
